If your property is in a Lee County special flood hazard area, the size of your project matters as much as the work itself.

Lee County follows FEMA’s Substantial Improvement and Substantial Damage requirements — the 50% Rule. Substantial damage means the cost of restoring a structure to its before-damage condition equals or exceeds 50% of the structure’s market value. Substantial improvement means any reconstruction, rehabilitation, addition, or improvement costing 50% or more of the structure’s market value before the work begins. Cross that line and the entire structure has to be brought into compliance with current flood construction standards, which can mean elevating it.

Two things make this more relevant in Cypress Lake than most people expect. The calculation uses the structure’s value, not the property’s — and on a 1970s home sitting on land that has appreciated substantially, an ordinary roof and window project can represent a large share of that number. And after Ian, Lee County adopted new FEMA flood maps, so a number of properties that previously sat at Base Flood Elevation now measure against a higher standard.
